These terms are an agreement between you and Core Axis Development (Pty) Ltd ("we", "us", "our"), which runs KZN Chess. They apply when you visit kznchess.co.za, create an account, take part in tournaments listed or managed here, use the training tools, or buy from the KZN Chess store.
We've written them in plain language. Please read them, especially the clauses in bold, which limit our responsibility or place obligations on you. If you don't agree, please don't use the site.
Nothing in these terms takes away rights you have under the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA) or the Protection of Personal Information Act 4 of 2013 (POPIA). If these terms conflict with those rights, the law applies.
1. Who we are
- Legal name: Core Axis Development (Pty) Ltd, a private company registered in South Africa, trading as KZN Chess
- Physical address and address for legal notices: 3 Syringa Road, Pennington, KwaZulu-Natal, South Africa
- Email: keagangilmore@gmail.com
- Website: https://kznchess.co.za
- VAT: Core Axis Development (Pty) Ltd is not registered for VAT, so no VAT is charged on our prices.
- Information Officer: Keagan Gilmore
KZN Chess is an independent platform. Unless a page says otherwise, we are not FIDE, Chess South Africa or a provincial chess association, and we don't organise the tournaments listed here.
2. Accepting these terms
- You accept these terms when you create an account, place an order, submit a tournament or otherwise use the site.
- If you are under 18, you may use KZN Chess only with the permission of a parent or legal guardian. They accept these terms on your behalf and are responsible for your use of the site.
- If you use the site for a club, school or other organisation, you confirm that you're authorised to accept these terms for it.
3. Your account
- Give us accurate information and keep it up to date. Your name may be shown publicly next to things you post (see section 5).
- Keep your password private. You're responsible for what happens on your account. If you think someone else has used it, tell us straight away at keagangilmore@gmail.com.
- Use one account per person. Don't create an account for someone else without their permission (or, for a child, their parent or guardian's permission).
- New accounts are player accounts. We grant organiser, tutor and admin access at our discretion and may withdraw it.
- If you forget your password, contact us and we'll help you reset it once we've confirmed who you are.
- You can ask us to close your account at any time by emailing keagangilmore@gmail.com. Our Privacy Policy explains what we keep afterwards and why.
4. Acceptable use
You must not:
- break the law, or use the site to harass, threaten, defame, discriminate against or impersonate anyone;
- post anything false or misleading, hateful, sexually explicit, violent or otherwise unsuitable for a community that includes children;
- upload photos or other material you don't have the right to share, or photos of identifiable children without their parent or guardian's permission;
- publish anyone's personal details (such as phone numbers, addresses or ID numbers) without their permission;
- send spam, or advertise or solicit on the site without our permission;
- scrape, harvest or bulk-download information from the site, including player information, other than through the export tools we give organisers to run their events;
- try to get around our security, access accounts or information you're not authorised to access, or interfere with the site (for example with malware or by overloading it).
We may remove content, restrict features, or suspend or close accounts that break these terms, and we may report unlawful conduct to the authorities. Where it's reasonable to do so, we'll tell you why.
5. Content you post
"Your content" means photos, captions, comments, tournament submissions and anything else you add to the site.
- You keep ownership of your content.
- You give us a non-exclusive, royalty-free licence to host, store, copy, display and adapt your content (for example, resizing a photo) on KZN Chess and in links and previews shared from it. The licence ends when the content is deleted, except for copies already shared by others or that we must keep by law.
- Your content is public. Photos appear on tournament pages, the gallery and the feed with your name, and comments appear with your name.
- By posting, you confirm that you have the right to post the content, and that anyone identifiable in a photo (or, for a child, their parent or guardian) is happy for it to be published.
- Photos and comments appear straight away; we don't review them first. We may remove any content at our discretion.
- To report content, or to ask us to remove a photo of you or your child, email keagangilmore@gmail.com with a link to it. We'll take down photos of people who ask us to.
6. Tournaments
For everyone
- Tournaments on KZN Chess are organised by third parties such as clubs, schools, associations and individuals, not by us, unless the listing says otherwise. The organiser is responsible for the event: the venue, schedule, entry fees, prizes, rules, arbiting, safety and any refunds.
- New submissions are shown as pending until we review them. Even after approval, we can't guarantee that a listing is accurate or that an event will go ahead, so please confirm details with the organiser using the contact details on the tournament page.
- Entry fees are paid to the organiser, not to KZN Chess.
- As is normal in chess, player lists, pairings, results, standings and crosstables are public. Our Privacy Policy lists exactly what is shown.
- Pairings and tiebreaks are calculated by software. The event's arbiters are responsible for checking them and for the official results.
For organisers, directors and arbiters
If you submit a tournament, or manage players, pairings or results:
- You're responsible for the accuracy of what you publish and for running the event under the applicable rules (for example FIDE or Chess South Africa rules).
- Before you add a player, you must have their consent, or for a player under 18 their parent or guardian's consent, for KZN Chess to process and publish their tournament details as described in our Privacy Policy. These details are name, ratings, FIDE and Chess South Africa IDs, club or school, district, sex, age category and results. You must be able to show this consent if we ask for it.
- Only enter what the event needs. Don't put ID numbers, dates of birth, contact details or health information into player fields.
- The contact name, phone number and email you enter for a tournament are published on the tournament page so players can reach you. Only enter details that the person has agreed to publish.
- Keep exported files (TRF and CSV) secure. Use them only to run the event and to submit results to rating bodies, and delete them when you no longer need them.
- Correct errors promptly when a player asks you to, and pass on to us any request you receive about information held on KZN Chess.
- We may edit, unpublish or reject tournaments, and remove organiser or arbiter access, at our discretion.
7. Learning and training tools
- Puzzles come from the Lichess open puzzle database, which is in the public domain. Puzzle ratings, progress, repertoires and review schedules are for training only.
- The FIDE Arbiter Trainer is study material, not official FIDE material. Always check the current FIDE Handbook for the authoritative rules.
- If you use the tutor tools to record students, sessions or notes, you're responsible for having the student's permission (or, for a child, their parent or guardian's permission). Keep notes accurate and respectful, and don't record sensitive information such as health details. These records are visible only to you in the app; our administrators access them only when needed to run, secure or support the service.
- Keep your own copy of anything important to you, such as your repertoires. We take care of your data, but we can't guarantee it will never be lost.
8. Buying from the KZN Chess store
These terms of sale apply to every order. Our supplier details are in section 1.
8.1 Products and prices
- We sell physical chess goods. Each product page describes the product's main features. Photos are for illustration.
- Prices are in South African rand (ZAR). Core Axis Development (Pty) Ltd is not registered for VAT, so no VAT is charged on our prices.
- The total at checkout is the price of your items plus the delivery fee, or nothing extra if you collect. The delivery fee shown at checkout is an estimate (see 8.4).
- If a price or description is clearly wrong, we'll contact you before we process your order, and you may cancel it for a full refund.
8.2 Placing an order
- When you place an order, we reserve the stock and give you an order number and a private link where you can follow your order. Keep the link private, because anyone who has it can see your order.
- Your order is an offer to buy. The contract between us is concluded when we accept your order, either by confirming it to you or by accepting your payment.
- We may decline or cancel an order, for example if stock was miscounted, a price is wrong or we suspect fraud. If you've already paid, we'll refund you in full.
- You can view your order at any time using the private link or, if you're signed in, under My Orders. You can save or print that page as your record of the transaction. We keep order records for as long as tax and company law requires.
8.3 Payment
- We accept payment by EFT (electronic funds transfer) into the bank account shown after you place your order. Use your order number as the payment reference. For collection orders we may also accept payment on collection. If online payment isn't available when you order, we'll contact you to arrange payment.
- We don't take card payments on the site and will never ask for your card details.
- We dispatch or hand over goods once your payment has cleared, unless we've agreed to payment on collection.
- If we don't receive payment within 7 days of your order, we may cancel it and release the stock.
- We will never ask you to pay into a different bank account from the one shown on your order page, whether by phone, email or WhatsApp. If anyone does, don't pay, and contact us.
8.4 Delivery and collection
- Courier delivery: we deliver within South Africa to the address you give us. The delivery fee at checkout is an estimate, and we'll confirm the final fee before dispatch. If the final fee is higher than the estimate, you may cancel the order for a full refund. Free delivery applies when your order reaches the threshold shown at checkout.
- Collection: you can collect your order free of charge from the collection point you chose, which may be a venue or a tournament. We'll tell you when it's ready. Bring your order number.
- When we confirm your order, we'll give you an expected dispatch or collection date. Unless we agree otherwise, we'll deliver your order, or make it available for collection, within 30 days of the day after we received it. If we don't, you may cancel the order by giving us 7 days' written notice. If an item becomes unavailable, we'll tell you straight away and refund what you paid for it within 30 days.
- Responsibility for the goods passes to you when they are delivered to your address or collected. Please check your goods when you receive them, and tell us as soon as possible if anything is missing, damaged or not what you ordered.
8.5 Cancelling within 7 days (cooling-off)
- Under section 44 of ECTA, you may cancel your order without giving a reason and without penalty within 7 days after you receive the goods.
- To cancel, email keagangilmore@gmail.com with your order number within that period. Then return the goods to the address we give you, at your own cost; the direct cost of returning them is the only charge you'll carry. Please send goods back in their original packaging where possible.
- We'll refund everything you paid for the order, including the original delivery fee, within 30 days of your cancellation.
- This cooling-off right doesn't apply to some goods excluded by section 42 of ECTA. These include books, magazines and periodicals; goods made to your specifications or clearly personalised; and audio, video or software that you've unsealed. You can still return these goods if they are defective or not what you ordered (see 8.6).
- You may also cancel any order before we dispatch or hand it over, for a full refund.
8.6 Faulty, unsafe or incorrect goods
- Under section 55 of the CPA, you have the right to goods that are of good quality, in good working order, free of defects, reasonably suitable for their purpose, and usable and durable for a reasonable time.
- If goods are defective, unsafe or not fit for purpose, you may return them to us within 6 months after delivery (section 56 of the CPA). At your choice, we'll repair them, replace them or refund you. We'll cover the reasonable cost of the return. If a repaired item fails again within 3 months, we'll replace it or refund you.
- This doesn't cover normal wear and tear, or damage caused by misuse, accidents or not following care instructions. It also doesn't cover a specific condition we told you about before you bought the item and that you accepted.
- If we deliver the wrong goods, the wrong quantity or goods damaged in transit, you may reject them. We'll arrange their return at our cost and replace them or refund you.
- Any manufacturer's warranty is in addition to these rights.
8.7 Refunds
- We refund by EFT to a South African bank account that you nominate.
- Unless a section above says otherwise, we make refunds within 30 days of the cancellation or of receiving the returned goods, whichever applies.
9. Advertising and other sites
- Some pages may show advertising served by Google. We don't endorse the products advertised. Our Privacy Policy explains the cookies that ads use.
- The site links to other services, such as WhatsApp, map links, FIDE and organisers' websites. We're not responsible for their content or practices, and their own terms apply.
- Share and "send via WhatsApp" buttons open WhatsApp with a pre-filled message. Nothing is sent until you send it yourself.
10. Our intellectual property
- The KZN Chess name, logo, site design, text and software belong to us or our licensors. Don't copy, change or reuse them except for normal use of the site.
- You're welcome to print and share pairings, standings and crosstables, and to share links to any page.
11. Availability of the service
- We work to keep KZN Chess available and accurate, but we provide it "as is" and "as available". We may change, suspend or stop features, and the site may sometimes be unavailable for maintenance or for reasons outside our control.
12. Limitation of liability
Please read this section carefully. It limits our responsibility to you.
- As far as the law allows, we are not liable for loss or damage arising from: your use of, or inability to use, the site; tournaments and events run by third parties; content posted by other users; inaccurate listings, pairings, results or ratings; or events outside our reasonable control, such as load-shedding, network outages or courier delays.
- As far as the law allows, we are not liable for indirect or consequential loss, such as loss of profit, data or opportunity.
- Nothing in these terms limits our liability for gross negligence or fraud, or anything that cannot be limited under the CPA. That includes your rights in section 8 and our liability under section 61 of the CPA for harm caused by unsafe goods.
13. Indemnity
You agree to indemnify us against claims, losses and reasonable legal costs that arise because you broke these terms, posted content that infringes someone else's rights, or (as an organiser) processed players' information without the consent that section 6 requires. This doesn't apply to the extent that the loss was caused by our own negligence or breach.
14. Suspending or closing accounts
- We may suspend or close your account, or remove your access to organiser, arbiter or tutor tools, if you break these terms, if the law requires it, or to protect other users. Where it's reasonable, we'll tell you why first and give you a chance to respond.
- Closing an account doesn't cancel orders you've already placed or affect your rights under section 8.
15. Privacy
Our Privacy Policy explains how we collect, use and protect personal information. It forms part of these terms.
16. Changes to these terms
- We may update these terms, for example when we add features or the law changes. We'll publish the new version on this page with a new effective date, and we'll let users know on the site about any material change.
- Changes apply from their effective date. They don't affect orders you've already placed; those follow the terms that applied when you ordered.
- If you don't agree to a change, stop using the site and ask us to close your account.
17. Complaints and disputes
- If you have a complaint, please contact us first at keagangilmore@gmail.com and we'll work with you to resolve it.
- If we can't resolve a consumer complaint, you may refer it to the Consumer Goods and Services Ombud (www.cgso.org.za) or the National Consumer Commission. Privacy complaints can go to the Information Regulator (see our Privacy Policy).
- These terms are governed by South African law, and South African courts have jurisdiction.
18. Legal notices
- We choose the physical address in section 1 as our address for service of legal documents (domicilium citandi et executandi). Please send all other notices to keagangilmore@gmail.com.
- We may send you notices by email to the address on your account or order. Under ECTA, email notices count as being in writing.
19. General
- These terms, together with our Privacy Policy and anything shown to you at checkout, are the whole agreement between you and us about the site.
- If any part of these terms is found to be unenforceable, the rest still applies.
- If we don't enforce a right straight away, we haven't given it up.
- You may not transfer your rights under these terms without our consent. We may transfer ours to another entity that takes over KZN Chess, as long as your rights are not reduced.
